Please read the following Terms and Conditions carefully and regularly as the Terms and Conditions may change without notice. Terms and Conditions are intended to help the user understand the relationship and the manner in which NorCap presents this information. This Site is interactive as it uses HTML forms and other technologies that store and read back browser cookies in a way that allows the user to access information on a demand basis. By accessing or using this Site, the user agrees to the following Terms of Use. It is NorCap’s preference that the NorCap Site helps and informs the user, but if the user does not agree to any Term or Condition, the user should not continue to access this Site. However, NorCap does not endorse a third-party provider, nor do they endorse NorCap. The user may link to NorCap’s content, but the user may not replicate any links or content.

10. The NorCap Site may not be published, distributed, or reproduced, in whole or in part, without written consent. NorCap trademarks, logos, trade names, and service marks used and displayed on NorCap’s Site are NorCap’s registered and unregistered trademarks and branding. Nothing available on this Site should be construed as granting any license or right to use any of NorCap’s branding, without NorCap’s written permission. A user may add NorCap’s Site to the user’s browser for a convenient revisit, but the user may not create a new browser, circumvent NorCap’s browser, or frame or create a border environment to collect, clip, replicate or feed NorCap’s content. NorCap is an Adviser to private funds and does not advertise, therefore, no NorCap branded materials may be used, clipped, transferred, or implied for marketing purposes without NorCap knowing of its purpose and use. 11. NorCap has an open-door “policy” and wants to communicate with the user. Email communication is provided so that the user may conveniently contact NorCap for the user’s business needs. When the user communicates with NorCap, it cannot guarantee that the transmission is completely secure. NorCap does not want the user to send confidential or proprietary information to NorCap through this Site. 12. The Terms and Conditions are provided for the user to understand the proper use of this Site is understood to prevent misuse. This Site is controlled from offices located within the United States. Accessing NorCap’s content from certain jurisdictions could be prohibited until qualifications or jurisdictional requirements are met. If the user chooses to continue to access this Site, they are doing so on their own initiative and must adhere to the user’s local laws. The terms and conditions are governed under the laws of the State of Texas whether it conflicts with the user’s jurisdiction or not. The user agrees that Texas is the exclusive jurisdiction for any claim, action, or conflict arising out of or relating to NorCap’s Terms and Conditions and the user agrees and submits to the exercise of personal jurisdiction of such courts for the purpose of litigation of any claim or action in the state or federal courts of the State of Texas. NorCap’s failure to enforce the performance of any Terms or Conditions is not to be construed as a waiver of any of NorCap’s rights or to exclude any liability for actions taken against these Terms and Conditions.
